Terms of Service
Please read these Terms and Conditions carefully before opening an account with us.
Your Account
In consideration of our accepting your application to open an account, you represent to us (and acknowledge that we rely on these representations) as follows:
You are 18 years of age or over. It is an offence for anyone under the age of 18 to open an account or to gamble on BETMELIVE;
You are of sound mind and capable of taking responsibility for your own actions and that you can enter into a legally binding agreement with us;
You agree to provide accurate registration information, including without limitation your correct date of birth and your country of residence. You agree to inform us of any changes in such details;
You are the person whose details are provided in connection with your registration or, in the case of legal entities, you are a duly authorized representative of the relevant legal entity;
You are not an undischarged bankrupt or in a voluntary arrangement with your creditors;
You are not located in a country where the use of our services is prohibited. You are entirely responsible for complying with your own local, national, federal, state or other laws concerning betting and gaming prior to opening an account, placing any bets or using our services;
You will, following a request from us (which may be made at any time before or after you open an account with us), promptly provide any documentation or information which we request in order to evidence your identity, age, address, country of birth or authorization to use a particular credit or debit card (and you agree that we may perform checks in order to verify any such documentation or information).
It is your responsibility to keep your contact details up-to-date on your account. Failure to do so may result in you failing to receive important account related notifications and information from BETMELIVE.
You are solely responsible for the security and confidentiality of your account. In particular, you agree to keep your username and password confidential, and you are responsible for any misuse of your password.
Provided that we have been correctly supplied with the account information requested, we are entitled to assume that offers and payments are made by you. You should change your password on a regular basis and never disclose it to any third party. You undertake to protect your username and password in the same way that you would in respect of your bank cards and any failure to do so shall be at your sole risk and expense. If another person accesses your account, you are solely responsible for all their actions whether or not their access was authorized by you and you hereby indemnify us and hold us harmless against all costs, claims, expenses and damages howsoever arising in connection with the use of or access to your account by any third party.
You will not attempt to sell or otherwise transfer the benefit of your account to any third party and nor will you acquire or attempt to acquire an account which has been opened in the name of a third party.
Multiple Accounts
Opening of multiple accounts on BETMELIVE is highly prohibited.
Should BETMELIVE believe, using its absolute and sole discretion, that you have:
registered and/or used more than one account; and/or
acted in collusion with one or more other individuals through a number of different BETMELIVE accounts to back the same combination of selections (regardless of whether or not such bets are struck separately, at a range of different amounts or on different days)
in an attempt to exceed the maximum pay-out for an individual account holder across linked accounts, it reserves the right to withhold any winnings arising from such behaviour.
Deposit and withdrawal of Funds
To bet or to play games for money on BETMELIVE, you need to deposit funds. Except as set out below, all funds in customer accounts are held by our server.
The funds in your account are held on your behalf by way of security to meet any payment obligations you may incur as a result of betting or playing games on our site or using any of the products or services supplied by BETMELIVE. Details of the manner in which the Trust is operated are set out in the Trust Deed.
You undertake that:
• All money that you deposit in your account is untainted with any illegality and, in particular, does not originate from any illegal activity or source; and
• All payments made into your account are authorized and you will not attempt to reverse a payment made into your account or take any action which will cause such a payment to be reversed by a third party, in order to avoid any legitimate liability.
You accept that all transactions may be checked to prevent money laundering and that any transactions made by you which BETMELIVE deems suspicious, may be reported to the appropriate authorities.
Identity verification is triggered upon the customer reaching the amount of Three thousand dollars ($3000) in deposits, which value can be calculated either on a daily basis taking into account all deposits effected by a customer since the establishment of the business relationship or a series of transactions within a rolling period of 180 days. We may also carry out these verification procedures even in case of lower deposits or in the case of withdrawals.
You accept that you will not be entitled to receive any interest in respect of your deposits, and you acknowledge that you shall not treat BETMELIVE as a financial institution.
The methods available for deposit of funds can be found once you are logged into your BETMELIVE account, and then by clicking on the “Deposit” button found at the top side of our home page.
The methods available for withdrawal of funds can be found once you are logged into your BETMELIVE account by clicking on the “My Account” icon.
Withdrawals will be remitted only to the account from where the funds paid into the customer’s account originated.
Suspension or termination
Either we or you may suspend or terminate your account at any time, either with or without cause, upon notice (we will use our reasonable endeavours to give such notice to you either before or after suspending or terminating your account). Please contact the BETMELIVE Helpdesk if you would like to close your account.
We may take steps to block you from betting on or using our site (or any part of it) if you are located in certain jurisdictions or countries where online gambling is prohibited.
Following termination or suspension of your account, the management of BETMELIVE, in the normal course of events, may return any funds in your account to you in accordance with the Trust Deed. Please contact the BETMELIVE Helpdesk to recover any funds held in suspended or closed accounts.
However, we reserve the right to notify or to withhold the funds in your account from you, pending the determination of any investigation (including any relevant external investigation) where:
We suspect you have acted in breach of these Terms and Conditions or any other agreement relevant to your activities on our site, including where we suspect the account has been linked with fraudulent or dishonest activity; and/or
we have to withhold the funds in your account by law or to comply with any advice, request or instruction from any governmental, regulatory or enforcement authority.
Following the determination of any such investigation we reserve the right to seize some or all of the funds in your account, if we are satisfied that you have acted in breach of these Terms and Conditions or any other agreement relevant to your activities on our site. We will deal with any funds obtained by us in this manner at our sole and absolute discretion and/or in accordance with any advice, request or instruction from any governmental, regulatory or enforcement authority.
In addition, if formally requested by the police, gambling regulators or taxation or other authorities or in the event that you fail to provide us with sufficient information to identify yourself in accordance with our own internal procedures or those imposed on us by regulatory authorities (wherever based) we may suspend your account and all functionality relating to the use of your account (e.g. bet management and withdrawal of funds) and to withhold from you any funds in your account pending determination of any criminal or other legal proceedings or investigation to which such a request may relate or until you provide the necessary 'know your client' or 'age verification' information as appropriate.
For the avoidance of doubt at no point during any such period will interest accrue to you on any funds in your account.
INDEMNIFICATION
User agrees to indemnify and hold betmelive.com, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of user's use of the Service, the violation of this agreement by the user, or the infringement by user, or other user(s) of the Service using user's computer, of any intellectual property or other right of any person or entity.
BEMELIVE INTELLECTUAL PROPERTY RIGHTS
1. The contents of the Website are protected by international copyright laws and other intellectual property rights. The owner of these rights is BetMelive, its affiliates or other third party licensors.
2. All product and company names and logos mentioned on the Website are the trade marks, service marks or trading names of their respective owners, including BetMelive.
3. Except to the extent required to use a product for the purpose of placing bets or stakes, no part of the Website may be reproduced or stored, modified, copied, republished, uploaded, posted, transmitted or distributed, by any means or in any manner, or included in any other website or in any public or private electronic retrieval system or service including text, graphics, video, messages, code and software without our express prior written consent.
4. Any commercial use or exploitation of the Website or its content is strictly prohibited.
Amendments
We reserve the right to make immaterial changes to these Terms and Conditions at any time.
If we make any material changes to these Terms and Conditions, we will give you as much prior notice of such changes as is reasonably practicable but, in any event, customers will be notified of material changes before they come into effect. Material changes will be communicated to you via a pop-up message on web and/or mobile when you log into your account. After being informed of the changes, you will be asked to ‘Agree’ to the changes to continue to use our services. Your continued use of the services after being notified of the material changes, and after indicating your acceptance of them, will be deemed to be your acceptance of the changes. If you do not agree to the material changes, then you will not be able to continue to use the services, but you shall always be able to withdraw your funds subject to these Terms and Conditions.
